يشكل قانون العقوبات، بما يحتوي عليه من نصوص -أقله نظرياً- سلاحاً بيد المجتمع إزاء الأمور التي يراها خطرة بالنسبة إليه، فضلاً عن كونه، بطبيعته، خطاباً رسمياً تقويمياً للأخلاقيات أو الحقوق الجديدة بالحماية وتحديداً للتصرفات التي تقسو عقوبتها وفقاً لدرجة خطورتها. وعلى هذا الأساس، يبدو القانون المذكور شديد الحضور لدى الناس، سواء في شؤونهم الخاصة أو العامة مما يجعل منه ميثاقاً اجتماعياً شاملاً.
وبالواقع يكتسي قانون العقوبات اللبناني أهمية إضافية كبرى بنتيجة التعددية الطائفية وهو قانون وضع في العام 1943 وطالته، من ثم، تعديلات محددة، وتالياً، فإن إعادة دراسته في ورشة إصلاحية شاملة إنما تشكل مناسبة لوضع رؤية مشتركة ترمي إلى تحصين السلم الأهلي وإلى ضمان استمرار يته وجزءاً من عملية تعزيز الخيار اللبناني، على ضوء الحاجات الاجتماعية المستجدة وبشكل خاص على ضوء التجاري والمحن التي خاضها لبنان منذ الاستقلال، ولا سيما خلال فترة الحرب.
وللأسف فإن الاقتراح التعديلي الذي وضعته لجنة تحديث القوانين في نهاية العام 2002 قد أتى دون الطموحات المذكورة. فعدا عن وضعه في عزلة تامة عن المجتمع، بدا في منطلقاته أقرب إلى حماية مصالح نظام سياسي معين منه إلى حماية مصالح المجتمع على أساس احترام الكرامة الإنسانية والمساواة بين الناس. وعلى هذا الأساس، أرادت هيئات مدنية عدة تحسيس الناس بأهمية القانون المذكور توصلاً إلى إشراكهم في ورشة تعديله. ومن هنا نشأت فكرة تنظيم منتدى "الكرامة الإنسانية في قانون العقوبات والذي صدر في 16 و17 أيار 2003 والذي يتضمن هذا الكتاب محصلة أعماله، علماً أن منظميه حرصوا في اختيار المحاضرين والمواضيع والمكان (مسرح) وكيفية تجهيز المنبر على إضفاء حيوية مميزة عليه بأمل كسر الحواجز بين القانون والناس.
