بعد أن زادت الأخطار والتهديدات للبيئة الإنسانية، وفاقت الآثار السلبية لتلك الأخطار والتهديدات حدود المألوف، وكثر وقوع الكوارث البيئية هنا وهناك في شتى أنحاء المعمورة، فلم يبق أمر الإهتمام والعناية بالبيئة وعناصرها قاصراً على العلوم التطبيقية وفي إطار الأبحاث والدراسات في ذلك المجال برغم أهميتها.
لا بل إن الإهتمام والعناية بالبيئة دخل عالم القانون - وفي ماضٍ ليس ببعيد - سواءً على الصعيد الدولي أم على الصعيد الوطني، ومن ذلك الإرادات المشرعة تسن وتشرع قواعد دولية وأخرى وطنية لأجل حماية البيئة وعناصرها من التلوث ومن المشاكل البيئية الأخرى.
والقانون الإداري هو ذلك القانون الذي يخاطب الإدارة، وأي نظام إداري لا بد له أن يتأثر بمشكلات البيئة ويساهم في حلها من خلال الصلاحيات والإختصاصات المناطة به، ولا سيما أن مشكلة التلوث البيئي والإستنزاف الجائر للموارد الطبيعية أو التعدي عليها من المستبعد مواجهته بصورة ناجعة وناجحة من غير تدخل الإدارة.
وبالتالي الحماية الإدارية للبيئة تعد من الوسائل القانونية المهمة، إن لم تكن أهمها، بما تضعه من تنظيم وأساليب وأنشطة لأجل الحفاظ على البيئة ومختلف عناصرها، الأمر الذي جسد ميلاد فرع جديد من فروع القانون الإداري، يضاف إلى فروعه التقليدية، وهو القانون الإداري البيئي.
يتمحور هذا البحث حول دراسة قواعد القانون الإداري البيئي الذي يستقي قواعده من التشريعات البيئية المتعددة، وكذلك من التشريع الخاص بحماية البيئة، بالإضافة إلى أحكام القضاء الإداري التي تستهدف حماية حق الإنسان في بيئة سليمة والحقوق المتفرعة عنه.
