يشغل مبدأ المشروعية ذهن العديد من المهتمين والدارسين في فقه القانون العام، ولعل ذلك يعود إلى أن هذا المبدأ هو الحيز الذي تحاول أغلب الدول الحديثة العمل ضمن مجاله، إلا أن إيجاد معنى منضبط لهذا المبدأ في نطاق عمل الإدارة أمر من الصعوبة بمكان، ويزداد الأمر تعقيداً إذا حاولنا أن نفهم معنى المشروعية في النطاق التأديبي الوظيفي، إذ تُعد السلطة التأديبية من أخطر سلطات الإدارة العامة تجاه موظفيها، لما تحمله في ثناياها من سلطات واسعة قد تصل أحياناً إلى إمكانية عزل الموظف من عمله.
فالتعسف وارد جداً من السلطة التأديبية والروح الإنتقامية قد تسود أحياناً من بعض الإدارات تجاه موظفيها فالسلطة كما قيل قديماً جموح ولا يوقف هذا الجموح إلا القانون.
ويلاحظ أن موضوع التأديب يجتذب عدداً كبيراً من الكتاب والباحثين في مجال القانون الإداري، ويعود ذلك إلى حيوية هذا الموضوع وشموليته، فالتأديب كما هو معروف ليس قاصراً على فئة الموظفين فحسب وإنما يشمل الجماعات الخاصة الأخرى كالنقابات والجمعيات.
وإن كان موضوع التأديب في مجال الوظيفة العامة قد نال الحظ الأوفر من البحث والدراسة إلا أن ما يمكن أن يقال عن هذه الدراسات أنها أما تتناول موضوع التأديب بصورة شاملة كونه نظرية عامة أو كونه عنصراً من عناصر الوظيفة العامة، أو إنها تتناول جانباً محدداً من جوانب الموضوع كالمخالفة التأديبية أو العقوبات التأديبية أو الإجراءات أو الضمانات وهكذا...
غير أن هذه الأطروحة نظرت إلى الموضوع التأديب من زاوية مختلفة وهي زاوية مشروعية هذا النظام في ظل دولة القانون، إذ عالج المؤلف هذا النظام من جميع عناصره إبتداء من أساسه ومدى إتفاقه وإختلافه مع النظام الجنائي كون النظامان تجمعهما سمة العقاب.
ثم سلط الضوء بشدة على كل ماله علاقة بعنصري التأديب الوظيفي وهما المخالفة التأديبية والعقوبة التأديبية مشددين في ذلك على الجوانب الشرعية لهذين العنصرين، وتوخياً للفائدة الاكبر عرض الموضوع عرضاً مقارناً بين أنظمة دول عديدة هي، العراق ولبنان ومصر وفرنسا.
وعليه، تم تقسيم الموضوع إلى بابين رئيسيين خصص الباب الأول لكل ما له علاقة بمفهوم المشروعية ضمن نطاق المخالفة التأديبية، حيث مهدّ المؤلف لذلك بإيضاح الأساس القانون للنظام التأديبي في مجال الوظيفة العامة، وطبيعة العقاب التأديبي ومدى إتفاقه وإختلافه مع العقاب الجنائي، أما الباب الثاني فقد خصص لفهم مضمون المشروعية في كل ما له علاقة بالعقوبة التأديبية وإجراءات فرضها.
