يحتوى هذا الكتاب على مقارنة في موضوع المسؤولية عن أضرار الجمادات مبتدءا بفكرة عن التطور التاريخي للمسؤولية عن فعل الأشياء. مبينا نظرية الشريعة الإسلامية لها مع مقارنتها بالقانون الفرنسي والقانون المصري ثم ينتقل الى عناصر المسؤولية عن الأشياء الحامدة شارحاً من خلالها مفهوم الحراسة. وعناصرها وما ارتبط بها من أحكام بالإضافة إلى موضوع الأشياء التي تثير المسؤولية الشيئية وتفصيلاتها وكما يتطرق إلى الأساس القانوني للمسؤولية من فعل الأشياء مع عرض النظريات الفقهية التي قيلت في أساس مسؤولية الحارس وموقف الشريعة الإسلامية من هذه النظريات ثم يقدم تطبيقات قضائية في تحديد الأشخاص المسؤولين عن فعل الجمادات منتهيا إلى خاتمة يتحدث فيها عن أهم النتائج التي استخلصت من البحث مشيراً فيها الى مميزات الفقه الإسلامي في معالجة هذه المسألة مشيداً بالنظرة الأصيلة له فيما يتعلق بالأطفال غير المشروعة.
