يقتصر نطاق هذا البحث على إحدى صور مسئولية الدولة بدون خطأ وهى المسئولية عن الأضرار الناجمة عن أعمال الشغب والتجمهر, والمسئولية هذه تحتاج بيان لمفهوم الشغب والتجمهر والخصائص التى يختص بها هذا الشغب, وصوره, وبيان جريمة التجمهر وأركانها, وتمييزها عن غيره من الصور التى تتشابه معه والأسباب التى تدفع إلى قيام الشغب والتجمهر وهذا تطلب منا إفراد الفصل الأول والثانى لدراسة مدخل خاص للتعرف على هذه الموضوعات, ثم نتناول فى الفصل الثالث النظام القانونى للمسئولية عن أعمال الشغب والتجمهر فنتعرف على نشأة وتطور مسئولية الدولة عن أعمال الشغب والتجمهر, ثم بيان موقف المشرع المصرى من هذه المسئولية.
وشروط انعقاد مسئولية الدولة عن أعمال الشغب والتجمهر ثم بيان الأساس الذى تعتمد عليه هذه المسئولية.
أما الفصل الرابع فسوف نخصصه لدراسة التعويض عن أعمال الشغب والتجمهر من حيث كيفية التعويض وتوزيع عبئه, والقضاء المختص بالمسئولية عن تعويض الأضرار التى تسببها أحداث الشغب والتجمهر وعلى ذلك تأتى دراسة هذا الموضوع فى الفصول التالية:
الفصل الأول: التعريف بالشغب والتجمهر, الفصل الثانى: صور الشغب, الفصل الثالث: النظام القانونى لمسئولية الدولة عن أعمال الشغب والتجمهر, الفصل الرابع, التعويض عن أعمال الشعب والتجمهر والقضاء المختص.
