من موقعه كخبير قانوني، عمل سنوات وزيراً في حكومة البحرين للشؤون القانونية. يسجل د.حسين محمد البحارنة ملاحظات حول الدستور الجديد الذي صدر يوم 14 فبراير العام 2002 في الذكرى الأولى للاستفتاء على ميثاق العمل الوطني في البحرين، ويقارن بينه وبين دستور دولة البحرين الذي أقره المجلس التأسيسي في العمل الوطني في البحرين، ويقارن بينه وبين دستور دولة البحرين الذي أقره المجلس التأسيسي في العام 1973، وصدق عليه أمير البحرين عيسى بن سلمان آل خليفة، آنذاك.
جملة من التراجعات، في حق التشريع والرقابة، التي تضمنها الدستور الجديد والتي جعلت المؤسسة المنبثقة عنه (المجلس الوطني) أقرب إلى مجلس الشورى نصف المنتخب، وبات من الطبيعي الاعتراض على هذا الدستور من قبل القوى الوطنية والإسلامية المنسجمة وتاريخها النضالي، والمعترضة على ما قام به الحكم من عدم التزام بما نص عليه ميثاق العمل الوطني بأن يكون المجلس المنتخب هو السلطة التشريعية، والمجلس المعين للشورى فقط.
دراسة لا غنى عنها لكل من يريد معرفة طبيعة التطورات السياسية التي حصلت في البحرين بعد الانفراج السياسي في العام 2001، ونوعية الإصلاحات التي أقدم عليها الحكم، وطبيعة الصراع الراهن الذي تخوضه القوى السياسية من أجل الحقوق الدستورية.
