ونحن على أبواب الألفية الثالثة, لا يزال الجدال محتدماً بين تيارين كبيرين من الآخذين بالتنشريعات الإسلامية, انطلاقاً من القرآن الكريم والسنة النبوية, تيار فلسفي ينادي بالأخذ الحرفي للنصوص وتطبيقها كما طبقت في صدر الإسلام, أي قبل أربعة عشر قرناً من الزمان, وتيار يرى أن الدين الإسلامي, هو دين ديناميكي نادى بأخذ عامل الزمن وتطور العلوم بعين الاعتبار, ويعتقد أيضاً أنه لا سبيل الى إنهاض هذه الأمة إلا ببث روح العصر الذي نعيش فيه, ويرى أن هذا الفعل لا يتناقض مع روح الإسلام بشيء. ويأتي هذا الكتاب ليساهم في إظهار الروح الديناميكية لهذه الشرائع, وتحريرها من نمطيتها وجمودها لتصبح قابلة في أن تعيش فينا ونعيش فيها دون ضرر ولا ضرار. وتعتبر هذه هي المحاولة الثانية للكاتب بهذا الصدد, بعد محاولته الأولى في كتاب القرآن بين التفسير والتأويل والمنطق العقلي.
