تكرس هذه السطور نفسها للحديث عن جانب مهم من هذا المشروع الثقافي، وهو الجانب الفقهي والقانوني تحديداً. لكن تجدر الإشارة إلى أن هذه السطور وإن كانت تعنى بالدرجة الأساسية بالمشروع الفقهي للشهيد الصدر؛ إلا أنها لا تفضل المحيط الفقهي العام عبر مقطع زمني تطور فيه الفقه الإسلامي، وفقاً لمذهب أهل البيت، تطوراً كبيراً، وقفز فيه الفقه قفزات هائلة، واجتاز مراحل فنية وفكرية عديدة، انتقل فيها من (رحم) الحديث ولغته الخاصة المفعمة بالأسانيد والعنعنة إلى شيء من الانطلاق والتحرر من أسْرِ هذه القيود، ليعلن عن نفسه وذاته وإن أبقي على متون الروايات والأحاديث في لغة الفقه وطريقة التعبير عن مسائله. ومع تطور وتنامي الخبرات وتضافر الجهود أخذ الفقه يكتسب شخصية مستقلة وإطاراً خاصاً، ليتوفر على شيء من الاستدلال والبرهان بعد أن كان الفقيه يختزل هذه المراحل ليصل إلى النتيجة التي هي، في الغالب، متن الحديث نفسه.
