الإضافة التي يقدمها كتاب الشريعة والمجتمع لا تقتصر على ربط معنى الشريعة بجدلية العلاقة، بين الكلي والجزئي، ولكنها تتصل أيضاً بتحديد الشريعة بالكليات، وإخضاع المعاني الجزئية إلى دلالات المعاني الكلية.
وترتبط أيضاً بسعيه إلى توسيع دائرة الشريعة خارج دائرتي فقه العبادات والمعاملات، وإدخال دوائر ومجالات حيوية أصبحت اليوم أساس التطور الإجتماعي والإنساني، أي في مجالات الحياة المدنية المشتركة، وفي الإقتصاد والإجتماع السياسي.
ويعني هذا فهم أثر المتغيرات الإجتماعية والتاريخية في أحكام الشريعة، والتغيرات في العادات والتقاليد، وفي التقنيات المستخدمة ووسائل التواصل والتخاطب والتعامل، وفي العلاقات الإنسانية والبنية الإجتماعية.
المقاربة التي اعتمدتها هذه الدراسة مقاربة مقصدية، تنظر في مقاصد الشريعة، وتسعى إلى تحديد المعاني الكامنة في النصوص، ولا تكتفي بالتوقف عند ظاهر النص؛ لأن الوقوف عند ظاهر النص؛ يؤدي إلى تجاهل المعنى الأساسي الثاوي في النص، فلا يمكن قراءته وإستنباطه بالنظر العابر، بل يحتاج إلى نظر عميق متأمل في دلالات النص وفحوى الخطاب.
قراءة النص الظاهر وتجاهل مقاصده، تفرز رؤية تاريخية لصيقة بأحكام وعلاقاتٍ ومؤسسات واكبت قراءة العلماء الذين أنتجوها، وتحول دون بناء مستقبل يستصحب معاني الشريعة، ويؤسس لبناء إجتماعي؛ يتناسب مع تطور المعارف والأدوات والبنى الإجتماعية والإقتصادية والسياسية.
