تنفيذ الجزاء الجنائي هو وضع الحكم الجزائي الذي قضى بالجزاء موضع التنفيذ، وبذلك فإن مرحلة التنفيذ مرحلة تالية لمرحلة المحاكمة، وهي مرحلة لها أهميتها لكونها تنقل النصوص القانونية والأحكام القضائية إلى حيز الواقع العملي، ومن هنا تكمن خطورة هذه المرحلة، لكونها الميدان الذي يتحقق فيه غرض الجزاء الجنائي، وهذا بلا شك يتطلب أن تخضع عملية التنفيذ لمبدأ الشرعية، ولذلك واجه المشرع الإشكاليات المتعلقة بالتنفيذ من خلال دعوى الإشكال في التنفيذ. ومما لا شك فيه أن هذه الدراسة تجد أهميتها من الناحيتين النظرية والعملية، فالمكتبة القانونية في فلسطين بحاجة ماسة إلى مثل هذه الدراسة، ويمكن القول بأن هذه الدراسة ستكون أول دراسة متكاملة في تنفيذ الجزاءات الجنائية في التشريع الفلسطيني، كذلك تجد هذه الدراسة أهميتها من الناحية العملية، فهناك بعض الأخطاء التي تقع في ميدان العمل بعضها يرد إلى الخطأ في تفسير النصوص والبعض الآخر يرجع إلى عدم وجود تنظيم مفصل للموضوعات التي يثيرها التنفيذ.
