ليس موضوع الشكوى بالغريب على الباحثين في حقل القانون، فاقد كان المجني عليه هو صاحب الحق المطلق في معاقبة الجاني أو العفو عنه، وإستمر هذا الوضع مع وجود نظام الإتهام الفردي الذي كرسته القوانين اليونانية وعرفه القانون الروماني والقوانين الجرمانية عموماً، والذي كان مبنياً على تخويل المجني عليه الحق في الإتهام ومباشرة الدعوى وتوقيع العقاب للمجتمعات والأفكار والمعتقدات السائدة فيها، وهي ظروف تتغير بتغير الزمان والمكان.
تهتم هذه الدراسة بالتوجه الجديد للتشريعات المقارنة نحو نظام الشكوى وغرض مجال التصالح بين افراد المجتمع فيما يتعلق بالجرائم الواقعة بينهم، وإن اختلفت التشريعات بين موسع لمجال جرائم الشكوى ومضيق لها، بحسب الأوضاع السياسية والإجتماعية.
ولمعالجة موضوع الشكوى قسم الكتاب إلى بابين: الباب الأول خصص للجانب الإجرائي تحت عنوان القواعد الإجرائية للشكوى، والباب الثاني خصص للجانب الموضوعي تحت عنوان تطبيقات حرائم الشكوى. بالنسبة للباب الأول فتم تقسيمه إلى فصلين؛
الفصل الأول تحت عنوان الحق في تقديم الشكوى تناول فيه المؤلف؛ ماهية الشكوى، أطرافها، معاييرها.
أما الفصل الثاني فتناول فيه ىثار الشكوى وانقضاء الحق فيها، والذي تم تقسيمه إلى مبحثين، أما المبحث الأول تناول فيه تحديد الآثار الإجرامية المترتبة على تقديم الشكوى. أما المبحث الثاني خصص لأسباب انقضاء الحق في الشكوى.
بالنسبة للباب الثاني فتم تقسيمه إلى فصلين؛ الفصل الأول تحت عنوان الحالات التي تبررها المصالح الأسرية، وكان يشمل في مبحثه الثاني الجرائم الماسة بأموال الأسرة.
أما الفصل الثاني فكان عنوانه الحالات التي تبررها المصالح الشخصية، فخصص المبحث الأول منه للجرائم الماسة بشرف وإعتبار المجني عليه والمبحث الثاني للجرائم الماسة بالحق بالخصوصية.
