إن الإنسان في حرصه المستمر على تحسين وضعه الإجتماعي، وفي سعيه الدائم لتحقيق ذاته، يتملكه هاجس الخوف من الفقر، والمرض، والحوادث، والعجز، والشيخوخة والموت، ويزداد الشعور بالخوف عند فئة من الناس لا تملك ما تواجه به هذه المخاطر، وقد كانت هناك أنظمة حماية متفرقة كان للمجتمع دور هام فيها، الا وأنها وعلى أهمية دورها في المجتمع، لم تستطع أن تغطي، بشكل أساسي، مختلف المخاطر التي يتعرف لها الفرد. من هنا قامت أنظمة الضمان الإجتماعي على مبدأ مشاركة المضمونين واصحاب العمل والدولة بنسب متفاوتة في تمويل هذا النظام وعلى الفصل بين التقديمات والاشتراكات بحيث يكون التضامن الإجتماعي هو الضمانة لتأمين الموارد اللازمة للتقديمات، وتمكنت هذه الأنظمة من تأمين الحماية من بعض المخافر التي لم تكن مشمولة بالأنظمة العادية. أن مفهوم الضمان الإجتماعي تبلور في ضوء انتشار المبادئ الإشتراكية في العالم وفي دساتير بعض الدول وفي إعلانات واتفاقيات دولية ذات نظرة انسانية تعتبر أن انماء الإنسان لا يمكن أن يتم من خلال المبادرة الفردية فقط، بل ضمن إطار مجتمع يؤمّن تكافؤ الفرص لجميع أبنائه. هذا وتختلف أنظمة الضمان الإجتماعي من بلد الى آخر سواء في أهدافها أم في تقنياتها. من هنا كانت الصعوبة في الالتقاء على تعريف موحد للضمان الإجتماعي، إلا أنه يمكن إيراد تعريفين له أو بالأحرى مفهومين: المفهوم الفرنسي الوارد في المادة الأولى من القرار التشريعي الصادر بتاريخ 4/10/45: "أنشئت مؤسسة للضمان الإجتماعي مخصصة لضمان العمال وعائلاتهم ضد أنواع المخاطر التي من شأنها إنقاص أو إلغاء قدرتهم على الكسب، ولتغطية أعياد الأمومة والأعياد العائلية التي يتحملونها". وأما المفهوم البريطاني فهو كما عرفه اللورد بفردج: إن هدف الضمان الإجتماعي هو إزالة حالة العوز عند كل مواطن عن طريق التأمين له، في كل حين، دخلاً كافياً لمواجهة أعبائه". ومهما يكن من أمر فإن لهذا الموضوع شرحه المسهب في أبواب هذا الكتاب الذي يشكل بمادته شرحاً لقانون الضمان الإجتماعي. وذلك ضمن أبواب ستة دارت حول المحاور التالية: 1- التعريف بالضمان الإجتماعي 2- مراحل وميدان تطبيق الضمان الإجتماعي 3- الضمانات الإجتماعية 4- التنظيم الإداري 5- التنظيم المالي 6- منازعات الضمان الإجتماعي.
