يأتي هذا الكتاب حول أعمال المصلحة في الوقف وهو يرمي إلى إتاحة الفرصة للأوقاف لتلج أبواباً من الخير وتنمية المجتمعات الإسلامية لا يمكن أن تلجها إلا عن طريق الدخول في غمرة الاستثمارات الحديثة من صناعات ومضاربات وزراعة وهو أمر يبدو أن العقبة الأولى التي تواجهه من بين عقبات أخرى هي النظرة الفقهية الموروثة في بعض المذاهب والتي تجعل الوقف ساكناً لا يتحرك وواقفاً لا يسير في وقت تنوعت فيه المؤسسات الخيرية غير الإسلامية في العالم وتنافست في توفير الخدمات الإنسانية متخذة من الاستثمارات الضخمة وسيلة لجني الأرباح الطائلة التي أصبحت ريعاً فائضاً يغطي احتياجات العمل الخيري دون أن تمس رأس المال بسوء.
وهو بذلك يرد على بعض الأسئلة الهامة التي برزت في هذا الزمان منها هل يجوز استثمار غلات الوقف الفائضة؟ هل يجوز الاستبدال والمعارضة للأوقاف الخربة أو العديمة أو القليلة الريع؟ وهل جواز صرف ريع وقف في مصرف غير الذي حدده الواقف فلو كانت وقفية مرصودة للتعليم هل يجوز صرف ريعها لإغاثة أهل كوسوفا مثلاً؟
تلك بعض الأسئلة العملية التي تدور وسيحاول هذا البحث أن يرد عليها من خلال قاعدة المصالح وأثرها الذي لا ينكر. ويقصد منه إبراز تأثير المصلحة في الوقف سواء فيما يتعلق بطبيعة المال الموقوف أو التصرف في عينه وتغيير معالمه أو فيما يتعلق بتحريك غلته للاستثمار أو التصرف بالغلة بتوجيهها إلى مصرف غير الذي حدده الواقف وتجاوز ألفاظ الواقف لفائدة قصده الذي تعرفه المصلحة.
وستكون خطة الكتاب التالي: أولاً: تعريف الوقف ومشروعيته باختصار. ثانياً: تعريف المصلحة وما تدخله من الأمور الشرعية للوصول إلى أن الوقف معقول المعنى مصلحي الغرض. ثالثاً: مظاهر تأثير المصلحة في الوقف مع الإشارة إلى ثلاث مدارس هي عبارة عن طرفين وواسطة.
