أصبحنا في عالم أزالت تقنيات الإتصال الحدود بين الدول وسادت ثقافة العولمة في مجالات عديدة للأنشطة الإقتصادية، وخلقت بيئة جديدة أتاحت للمتعاملين وسائل متطورة للإعلان عن السلع والخدمات، ومن ئم التعاقد عليها وتنفيذها أحياناً عبر النقل الآلى للبيانات المجسدة للأداءات محل الإلتزام وذلك كله دون حاجة للتواجد المادى، أو الشخصي في موقع الحدث. ونظراً لما تتمتع به هذه الشبكات من سرعة ومن توقير في الوقت والتكاليف ومن فتح آفاق وأسواق دون عناء، فقد وجد فيها التجار مطالبهم، بل حلمهم الخيالي؛ وبدأنا نسمع عن التسةق الإلكتروني والمعارض الإفتراضية.
وفي هذا الكتاب تناول المؤلف تعريف شبكة الإنترنت، وتطور هذه الشبكة من شبكة حربية إلى شبكة تجارية، وأخيراً عرض أهم الخدمات المتاحة على هذه الشبكة العالمية على سبيل المثال وليس الحصر.
وقد قسم الكتاب وفق ما يلي: الباب التمهيدي خصص لتعريف التجارة الإلكترونية وخصائصها وصورها ومزاياها، أما الباب الأول في الفصل الأول فقد تناولنا أركان عقد التجارة الإلكترونية من حيث تكوين التراضى من خلال الإيجاب والقبول الإلكتروني ومن حيث تكوين التراضى حيث عيوب الإرادة والأهلية اللازم للتعاقد والمحل والسبب ثم تناولنا زمان ومكان إبرام هذا العقد، كما تناولنا في الفصل الثاني توثيق الإرادة من خلال دراسة السجل الإلكتروني وتناولنا توثيق التعبير الإلكتروني من خلال دراسة التوقيع الإلكتروني وتناولنا الإثبات الألكتروني، أما الباب الثاني فقد تناول التحكيم وفض منازعات عقد التجارة الإلكترونية وتناولنا في الفصل الأول ماهية التحكيم الإلكتروني ومزاياه، أما الفصل الثاني فقد تناول إبرام إتفاق التحكيم من حيث شكل هذا الإتفاق والأثار المترتبة على مثل هذا الإتفاق ثم القانون الواجب التطبيق على إتفاق التحكيم وأخيراً إجراءات التحكيم وخصوصيته في العالم الإفتراضي.
