من المعلوم أن الشريعة الإسلامية تضم أحكاماً شرعية في المعاملات الدينوية يمكن حصرها في الأقسام الآتية وهي: العبادات، والأحوال الشخصية، والمعاملات، والحدود، العقوبات، والمرافعات، وهذه الأخيرة هي موضوع الكتاب وأما المقصود بها الدعوى وطرق إثباتها والقضاء.
يضم الكتاب جميع الأحكام الشرعية في (المرافعات الشرعية) ويبدأ (بالدعوى) وشروطها وأنواعها وحكمها ويتطرق إلى الخصوم وكيفية سير القاضي مع الخصوم، إضافة إلر (رفع الدعوى) أي قبول الدفع من غير المدعى عليه وعدم قبوله، و(حكم الدفع)، والتناقض بين شخصين، ودعوى الرجلين على ثالث، وحكم دعوى أحدهما الكل والآخر البعص، والدعوى في حال الوفاة، يلي ذلك (الإقرار) شروطه، سماع البنية مع الإقرار، مسائل الإقرار.. الخ، ثم (الإستثناء) والبنية، و(شروط الشهادة) و(المسائل المختلف فيها) و(الرجوع عن الشهادة) والنكول عن اليمين، والفرق بين النكول والإقرار، و(صيغة اليمين) وكيف يكون التحليف، و(القضاء) والصفات التي ينبغي أن يكون القاضي متصفاً بها، وما يبطل به الحكم وما يلا يبطل... وأخيراً طرق الطعن في الأحكام والتحكيم، والقضاء على الغائب...الخ.
