تحت عنوان "المجتهدون في القضاء" يقدم الدكتور صبحي محمصاني مختارات من أقضية السلف تضمنت اجتهاداتهم في بعض القضايا، قبل تبلور المذاهب المعروفة، وقبل تأصلها وانتشارها. فكانت تلك الأقضية سابقات أثارت بعض النقاط الحساسة، وبعض المسائل المهمة ومفيدة لتكوين هذه المذاهب نفسها، ويخص الكاتب بالذكر منهم ثلاثة، اشتهروا في التاريخ العربي في بداية نشوء المذاهب الفقهية وقبل تثبيتها بصورة واضحة، وهم شريح الكندي، وإبن أبي ليلى، وإبن شبرمة، فهؤلاء تفرغوا للقضاء مدات طويلة، ولم تسنح لهم ظروف عملهم بالفرصة للعناية بالتأليف النظري، والتصنيف العلمي، لهذا حاول الكاتب – كما يقول – إبراز هذا التراث القضائي، بالتقاطه من زوايا كتب التاريخ والمذاهب، ومن بطون المراجع المختلفة، ثم تدوينه في هذا الكتاب، وذلك في ضوء بعض المقارنات الضرورية، بما يقابلها أو يعارضها من مذاهب قديمة، أو نظريات حديثة. وذلك بتسليط الضوء على أهم القضايا والمسائل من أمور (المعاملات) التي عُرضت على أولئك القضاة، مع الإشارة إلى بعض الفتاوى المهمة، التي أفتوا بها أثناء ممارستهم القضاء.
