كانت الغاية من تصنيف هذا الكتاب استخلاص النظرية العامة للالتزام في الشريعة الإسلامية على ضوء مذاهبها المختلفة، وذلك بلغة النظريات العصرية وبحلة الأسلوب الفقري الجديد، تسهيلاً للمقارنة والمقابلة بين التراث العربي القيم وبين مبادئ القانون الحديث، وقد صدرت الطبعة الأولى من الكتاب منذ قرابة ربع القرن... وكان الإقبال عليها كبيراً، إذ نفذت نسخها بعد بضع سنوات. ثم ازداد الإلحاح بطلب إعادة صنع الكتاب، لا سيما في الستينات من هذا القرن، بمناسبة النهضة الفقهية والقانونية الجديدة في البلاد العربية، على أثر إعادة النظر في تنظيماتها وتجديد تشريعاتها. هذا ما أوجب على المؤلف إعادة إخراج طبعة ثانية من الكتاب ثم هذه الطبعة الثالثة، وقد حرص على بقائها كسابقتها، من حيث الحجم والترتيب والمضمون، محافظة على غاية الكتاب الأصلية، وتورعاً من التطوير الذي قد يعسر الاطلاع ويعطل الفائدة، وذلك طبعاً باستثناء بعض التنقيح البسيط أو الزيادة الطفيفة، اللذين اقتضتهما إعادة الصنع.
