هذا الكتاب في الأصل دراسة عن التفاعل القانوني في حوض البحر الأبيض المتوسط، قدم لجامعة مونس وقد عمل المؤلف على توسيعه ليخرج بهذا الحجم. فموقع منطقة حوض البحر الأبيض المتوسط أهلها لأن تلعب دوراً أساسيا قي قيام الشعوب وفي رسم معالم الحضارة الإنسانية الأولى، ومنذ القدم تحفف التفاعل بين مدن الهلال الخصيب والشاطئ السوري الفينيقي الكنعاني وبين الشاطئ الأفريقي الشمالي والغربي وبين أرخبيل اليونان وجزر البليار والكناري وصقلية وسردينيا وكورسيكا وشواطئ إيطاليا وفرنسا وإسبانيا والبرتغال.
وقد ظلت آثار هذا التفاعل قائمة حتى الآن والشواهد عليه كثيرة، وقد بين المحامي الدكتور خضر الحموي في دراسته هذه أن الارتباط والنماذج والتفاعل القانوني بين جميع بلدان حوض البحر الأبيض المتوسط قائماً قديماً وحديثاً ونحن أشد ما نكون بحاجة إليه في عصرنا هذا الذي شهد ظهور عدد من التجمعات والتكتلان الدولية كالسوق الأوروبية المشتركة والمجموعة الأوروبية الاقتصادية وهو يرى ضرورة قيام منظمة أو هيئة لبلدان حوض البحر الأبيض المتوسط، مما يسهل عملية تقارب بلدان حوض البحر الأبيض المتوسط، كما يدعو إلى اعتماد التحكيم الدولي والتحكيم الخاص لما لهما من تأثير في تشريع الأحكام وإرساء العلاقات القانونية بين الدول والمؤسسات العامة والخاصة والشركات الدولية والإقليمية.
