رفت المادة 453 من قانون العقوبات التزوير بأنه تحريف متعمد للحقيقة، ة، في الوقائع والبيانات التي يثبتها صك أو مخطط بشكل مستنداً بدافع إحداث ضرر مادي أو معنوي أو اجتماعي، إلا أن التعريف المبين أعلاه لجريمة التزوير، رغم وضوحه ودقته، فقد اقتصر على تزوير المستند الخطية، وهذا يشكل مفهوم تقليدي ضيق تجاوزه التشريع الحديث كما نجد ذلك في التعديل الذي أدخله المشرع الفرنسي على مفهوم التزوير الوارد في المادة 441/1 من قانون العقوبات تعبير أنه يشكل تزويراً كل تحريف تحايلي للحقبة من شأنه أن يسبب ضرراً، سواء أتم ذلك كتابه أو بأية وسيلة تعبير أخرى ترمي إلى إثبات حق واقعة ترتيب عليها نتائج قانونية.
وجرائم التزوير باعتبارها تقوم على تحريف تحايلي للحقيقة تتم بطرق عديدة إما بأفعال مادية (مثل تزييف العملة) وإما شفاهه أو بالكلام (مثل جرائم الشهادة الكاذبة واليمين الكاذب)، وإما بالكتابة 0مثل تزوير السندات الرسمية أو تذكرة الهوية أو جواز السفر).
وبالحقيقة إذا أخذنا بالمفهوم الواسع لجرائم التزوير لاستغرقت هذه الجرائم غالبية الجرائم المنصوص عنها في قانون العقوبات مثل: جرائم انتحال الصفات أو الوظائف، جرائم اختلاف الجرائم والافتراء، جرائم الهوية الكاذبة وشهادة الزور والتقرير الكاذب واليمين الكاذب... وجرائم التزوير بالمعنى الضيق إما أن تتم عن طريق تزوير مادي أي بإجراء تحريف أو تحرير في مستند صحيح بإضافة أو تحشيه كتابة ما أو تغيير أو محو أو شطب كلمات أو أحرف وما شابه.
وهذا النوع من التزوير يمكن التحقق منه وإثباته بوسائل وطرق فنية وعلمية. وإما أن يكون التزوير معنوياً فلا يمكن تنبيه في مادة المستند أو كتابته، وإنما نجد في تحريف مضمونه أي من البيانات التي يشتمل عليها، ويحصل التزوير المعنوي في المستند عند تحريره بحيث يتضمن بيانات وتصريحات غير صحيحة، وذلك لا يكتشف التزوير المعنوي من خلال علامات أو آثار مادية ظاهرة، أو ملموسة، وإنما بإثبات تزوير أو عكس البيانات والتصريحات غير الصحيحة.
في الكتاب الذي بين أيدينا نجد حلولاً للعديد من المسائل القانونية المتعلقة بالتزوير نذكر منها: ما يتعلق بالإثبات، وبالاختصاص، وبالتزوير المدني، والتزوير الجزائي، بجريمة استعمال مزور، وبالتزوير المادي، وبالتزوير المعنون وبتزييف النقد، وبجرائم التزوير المختلفة التي تتناول المستندات الرسمية وغير الرسمية، ويتذكره الهوية وبجواز السفر، وبما يتعلق بمرور الزمن على جرائم التزوير وتاريخ بدئه وما إلى ذلك.
