تشكل قضية المياه في المجتمعات الشرق أوسطية إحدى أبرز القضايا الاجتماعية والسياسية والاقتصادية التي عاصرتها على مر الأجيال لما لهذه الطاقة من أهمية في حياة الأمم وتطورها من جهة ولقلتها وندرتها في الشرق الأوسط من جهة ثانية، وقد استقرت القرى والمدن على مقربة من الينابيع المتفجرة والأنهر الجارية لحماية هذا المورد والاستفادة منه والدفاع عنه وقد خلصت دراسات عديدة إلى ربط مظاهر السلطة في الشرق بتملك مصادر المياه كما شرحها بالتفصيل المفكر Karl Wittfogel في مؤلفه عن "الاستبداد الشرقي".
لذلك لقد فرض على المجتمع اللبناني المثابرة في تنظيم قطاع المياه لتأمين سلامة التصرف به من قبل المواطنين وللتخفيف من حدة الصراعات بينهم، فاستقر المجتمع على مجمل عادات وتقاليد تركزت من خلالها، أطوار استعمال المياه في العصور الغابرة.
بقيت الحال في لبنان مسندة إلى تلك العادات والتقاليد خلال فترة طويلة من الزمن ولغاية صدور مجلة الأحكام العدلية باستثناء مؤلف المطران عبد الله قراعلي الموضوع في القرن الثامن عشر تحت عنوان "مختصر الشريعة" والذي سجلت فيه تلك العادات والتقاليد المرعية الإجراء في أيامه.
فمع صدور مجلة الأحكام العدلية التي ما زالت بعض أقسامها الخاصة بالمياه سارية المفعول، أخذت تتركز العلاقات على أسس قانونية ثابتة علماً بأن المجلة قد أكدت على قسم كبير من العادات والتقاليد الغابرة.
لهذه الأسباب قضت المنهجية العلمية معالجة أوضاع المياه في لبنان نسبة إلى النصوص التاريخية والقانونية والعادات والتقاليد في الباب الأول من هذا المؤلف ودراسة الوضع الحديث لهذا القطاع على ضوء التشريع والاجتهادات منذ عام 1925 في الباب الثاني ومن ثم دراسة أوضاع الامتيازات في لبنان في الباب الثالث وواقع المياه اللبنانية في مفاوضات الشرق الأوسط في الخاتمة العامة.
