يتناول هذا الكتاب مسألة من أهمّ مسائل القانون، وهي مسألة المصادر، لا بمعنى الظروف التاريخيّة والإجتماعيّة والإقتصاديّة والثقافيّة والسياسيّة، التي قد تؤثّر على واضعي النصوص أو على تفسيراتهم لها، بل بمعنى المعطيات، التي ينطلق منها عمل ممارسي المهمّات الحقوقيّة من قضاة ومحامين ومستشارين لدى السلطات المختلفة، وتدور نقاشاتهم وسجالاتهم ومعاركهم حولها في المحاكم أو الأروقة أو على صفحات المجلات المتخصّصة وحتّى الجرائد اليوميّة.
في معالجتنا لمصادر القانون المختلفة استقرأنا معظم النظريات المتعلقة بالموضوع، وراجعنا آراء الفقهاء لنخلص إلى نتائج نعدّها الصواب.
ولما كان موضوعنا يتعلّق بالقانون الدستوريّ اللبنانيّ، فقد تحرّينا، ليس فقط عن مصادره الواضحة المتّفق عليها كالنصّ والإجتهاد، بل والخلافيّة كالميثاق الوطنيّ والأعراف، ودرسنا في كلّ ذلك الثغرات والتناقضات وطرق التغلب عليها.
وخصّصنا في كلّ موضوع حيّزاً للطابع القانونيّ وللمستوى في التراتبيّة الحقوقيّة من الناحيتين الشكليّة والموضوعيّة.
وإذا كنّا لا ندّعي الكمال في بحثنا هذا الموضوع الشائك وغير المطروق، فإنّنا نتقبّل الملاحظات والنقد ممّن يتطوّع مشكوراً لإبدائها، فتعترف بجميله وندرسها، وستظهر آثارها، إن شاء الله، في طبعات لاحقة.
