في كتابه المعنون "لمحة في التشريع المقارن" يحاول المؤلف الأستاذ فخر الدين أسعد الصاحب التأكيد على أن التشريع الإسلامي غير منقول عن التشريع الروماني، أي أن الشريعة الإسلامية قائمة بذاتها، وليست مأخوذة من غيرها بأي وجه من الوجوه.
كما ورد عند أهل الإختصاص، وكما يزعم المستشرقين من تأثر الفقه الإسلامي بذلك القانون، ويبرهن على ذلك المؤلف بعد النظر في مصادر التشريع الإسلامي وعن طريق تطبيق القانون المقارن على أمثلة عملية واقعية مثل الميراث ومشروعية التبني ومشروعية القصاص والعدة والمهر والطلاق بين الزوجين وعقوبة السجن والربا وغيرها، وفي هذا يقول: "سوف لن أقصر أبحاثي التي سأطرقها على القانون الروماني فحسب، بل سأتخطاه إلى التشاريع الأخرى، فأدلِّل بهذه الوسيلة لا على عدم تأثر الفقه الإسلامي بالقانون الروماني فحسب، بل على عدم تأثره بتشاريع الأمم الأخرى".
وبهذا المعنى يؤكد المؤلف أن الشريعة الإسلامية حيّة وقابلة للتطور، ويبقى الرجوع إلى كتاب الله تعالى "القرآن الكريم: في كل المسائل خيرٌ وأولى.
