ابن رشد هو محمد بن أحمد بن رشد المالكي، والمكن أبا الوليد. قرطبي، زعيم وقته بأقطار الأندلس والمغرب ومقدمهم، المعترف له بصحة النظر وجودة التأليف، ودقة الفقه. وكان إليه المفزع في المشكلات، بصيرا بالأصول والفروع والفرائض، والتفنن في العلوم، وكانت الدراية أغلب عليه من الرواية، كثير التصانيف ألف كتاب "البيان والتحصيل، لما في المستخرجة من التوجيه والتعليل" وهو كتاب عظيم نيفا على عشرين مجلداً، وكتاب المقدمات لأوائل كتب المدونة" وهو الكتاب الذي يقلب صفحاته واختصارا لكتب المبسوطة من تأليف يحيى بن إسحاق بن يحيى بن يحيى، وتهذيبه ككتب الطحاوي في مشتل الآثار، وأجزاء كثيرة في فنون من العلم مختلفة كانت إليه الرحلة للتفقه من أقطار الأندلس مدة حياته. وقد ألف كتابه المقدمات الممهدات في الفقه المالكي وذلك لبيان ما اقتضته المدوّنة من الأحكام الشرعية ومن أمهات المسائل الفقهية.
