ألف القاضي أبو الوليد؛ محمد بن أحمد ابن رشد القرطبي (الجد) كتاب المقدمات الممهدات لبيان ما اقتضته رسوم المدونة من الأحكام الشرعيات، والتحصيلات المحكمات لأمهات مسائلها المشكلات، حين طلب منه بعض من كان يحضر مجالسه الفقهية أن يجمع ما كان يلقيه عليهم عن إستفتاح أبواب المدونة، وفي أثناء بعضها مما يحسن المدخل به من معنى عنوان الباب وإشتقاق لفظه وتبيين أصله من الكتاب والسنّة وما اتفق عليه أهل العلم من ذلك واختلفوا فيه، ووجه بناء مسائله عليه وردها إليه، وربطها بالتقسيم لها والتحصيل لمعانيها.
ولما ألف ابن رشد - في آخر عمره - كتاب البيان والتحصيل طلبوا منه أن يضع له مقدمات يمهد بها في أول كل باب منه على غرار ما فعله بالمدونة، وكان حينئذ لم يخرِّج المقدمات من مسودتها، فرأى أن يكتفي بالمقدمات كتمهيد للبيان والتحصيل وإستخرجها خالصة.
ولما عاد من مراكش إلى قرطبة في 22 جمادى الأولى عام 520هـ تهافت عليه طلبة الفقهاء يسألونه إسماع ما بقي من البيان والتحصيل أو المقدمات الممهدات، فآثر رغبة من رغب في المقدمات، وأخذ أبو مروان بن مسرة يقرؤها بين يدي ابن رشد في الأصل الذي انتسخه الشيخ لنفسه وهو ممسك بالمسودة إلى أن أكملوا في اثنين وعشرين يوماً قراءة تسعة عشر جزءاً (أو كتاباً) - وعدة أجزاء المقدمات 27 فمرض الشيخ ولزم الفراش أربعة أشهر وأياماً إلى أن مات ليلة الأحد 11 ذي القعدة عام 520هـ.
وغلى هذا، فإن المقدمات ليست من فروع الفقه العادية ولا من كتب الأصول، وإنما هي بِدْعٌ من التأليف يحتوي على دراسات وتأملات فقيه مالكي ضليع بلغ درجة الإجتهاد المذهبي؛ بل الإجتهاد لامطلق، ينظر في ميدان الخلاف العالي وينافح عن مذهبه المالكي - عند الإقتضاء - بالحجة والبرهان.
وقد تم الإعتناء به من خلال عملية تحقيق، جاءت على الشكل التالي: 1-وقف المحقق على عدد من مخطوطات المقدمات في خزائن فاس، ومكناس، والرباط، وكلها ناقصة من الأول أو الأوسط أو الآخر، إلا أن المحقق تمكن من تلفيق نسخ كاملة منها، 2-وسلك في عملية التحقيق نفس النهج الذي كان قد سار عليه في البيان والتحصيل من الإجتزاء بمقابلة النص في النسخ المخطوطة والمطبوعة، وإثبات ما اتفقت عليه كلها أو معظمها، أو ما عمد المحقق إلى ترجيحه مما وقع فيه لبس أو إضطراب، مع التنبيه في الهامش إلى ما هنالك من نقص أو زيادة أو تصحيف كلما رأى ضرورة ذلك، والعناية بترقيم الآيات القرآنية وتخريج الأحاديث النبوية.
وهكذا تم نشر هذا الكتاب "المقدمات الممهدات لبيان ما اقتضته رسوم المدوّنة من الأحكام الشرعيات والتحصيلات المحكمات لأمهات مسائلها المشكلات "لمؤلفه أبي الوليد محمد بن أحمد ابن رشد القرطبي المتوفي عام 520هـ، لأول مرة في العام 1987م وذلك ضمن أجزاء ثلاثة.
