بدون أدنى شك أن الحروب كانت وما زالت المصدر الرئيسي لكل الويلات والدمار الذي أصاب المجتمعات الإنسانية قاطبة، إن هذه الحقيقة المُثبتة دفعت الفقيه محمود شريف بسيوني إلى إحصاء عدد النزاعات المسلحة التي نشبت في العالم بعد إنتهاء الحرب العالمية الثانية والتي وصلت لأكثر من 250 نزاعاً مسلحاً أزهقت أرواح ما يقارب السبعين مليوناً.
بمعنى آخر، فإن هذا الرقم يفوق عدد القتلى الذين سقطوا أثناء الحربين العالميتين الأولى والثانية مجتمعتين، لكن المؤلم هنا هو ان مُسببي هذه النزاعات وموجات التقتيل الذي صاحبها غالباً ما يفلتون من طائلة المسؤولية والعقاب؛ ونعتقد أن الإفلات الذي يأخذ صورة الإعفاء من العقاب هو الذي دفع المجتمع الدولي للتأكيد على أن وجود القضاء الجنائي الدولي يعد الحل الوحيد لمواجهة الإفلات من المسألة والعقاب.
لهذا عالج المؤلف في القسم الأول من دراسته اثنين من أكبر الإنتهاكات الخطيرة للقانون الدولي، هما الجريمة ضد الإنسانية أولاً ثم الإبادة، ويكون ذلك من خلال تحديد أصولها الأولى، عناصرها الأساسية وتلك المكونة لها ومن ذلك تشخيص طبيعة الهجوم الموجه ضد السكان المدنيين، دور الموظف العمومي في إطار هذا الهجوم، هذا بالنسبة للجرائم ضد الإنسانية، أما بخصوص الإبادة فحاول المؤلف تحديد القصد الإبادي كعنصر خاص في الإبادة، وأخيراً الأفعال المكونة للركن المادي في جرائم الإبادة والجرائم ضد الإنسانية والتي ستنال أيضاً قسطاً من المعالجة والتحليل في هذه الدراسة وخصوصاً تلك الأفعال المُرتكبة في زمن المسلم.
وفيما يتصل بالقسم الثاني فكرسه لتلك المشاكل المُلازمة للتعاون الدولي، حيث إن التعاون يمكن أن يتحقق من خلال معاهدات التسليم للمسؤوليين المُفترض إرتكابهم للجرائم الدولية، أو حتى بالتعاون الكامل بين الدول والمحاكم الجنائية الدولية المُنشئة ليوغسلافيا السابقة ورواندا من قبل مجلس الأمن، إضافة لمعالجة المستفيضة لمبدأ التكامل بين المحكمة الجنائية الدولية والقضاء الوطني كوسيلة حديثة جاء بها نظام روما الأساسي لتشجيع القضاء الوطني على ممارسة جدية وحقيقية لدوره في ملاحقة ومقاضاة المسؤوليين عن إرتكاب الجرائم الدولية.
