تحرم الشرائع السماوية والوضعية أخذ مال الغير عنوة أو الاستيلاء عليه بقصد التملك، وأقدم الشرائع تعاقب على هذه الجريمة بقسوة لكن فقهاء القانون يميزون بين السرقة والجرائم الملحقة بها فعلى سبيل المثال تعتبر جريمة إخفاء المسروقات مستقلة عن جريمة السرقة نفسها وقد وضع المحامي نزيه شلالا هذا الكتاب وهو عبارة عن دراسة مقارنة من خلال الفقه والاجتهاد والنصوص القانونية حيث عرض لأهم الاجتهادات والآراء الفقهية التي تناولت هذا الموضوع.
ويحدد الفقهاء أركان جريمة السرقة والتي لا تعتبر السرقة جناية بدونها، يعرض المؤلف في المقدمة: السرقة والابتزاز وإثبات واقعة الكسر والخلع، أخذ المال عنوة وإخفاء المسروقات وحكم كل منها. ويعرض لبعض الدعاوى التي استمعت إليها المحاكم اللبنانية بهذا الخصوص، كما يعرض في الملاحق للسرقة في قانون العقوبات اللبناني والسوري، والسرقة في قانون الجزاء الهمايوني، وفي القانون الجزائى الفرنسي، والفرنسي لسنة 1810. كما يعرض للسرقة في بعض مواد قانون الجزاء العثماني المعدل وأخيراً يعرض للسرقة في قانون العقوبات العراقي.
