تحتل القرارات القضائية أهمية خاصة لدى المشتغلين بالقانون وفروعه، فالمشترع مهما أوتي من نفاذ في البصيرة ورجاحة في العقل يصعب بل يكاد يستحيل عليه الإلمام بكافة الظروف والمستجدات التي يفرضها الواقع العملي أمام أقواس المحاكم، وهنا يبرز دور القاضي الساهر على تطبيق القوانين محاولاً بما كونه من خلفية قانونية إيجاد حلاً عادلاً وشاملاً للنزاع المفروض أمامه وهذه القرارات القضائية وعلى الأخص الصادرة عن المحكمة العليا-محكمة التمييز- تمتاز بأنها نهاية المطاف حول كافة الشكوك التي تثور بين ما يطرح على درجات القضاء الأدنى منها، فهي تصدق أو تفسخ ما يطعن به أمامها، وتطبق أو تنشأ اجتهادات جديدة في غياب النصوص القانونية.
وكما هو معلوم للكافة إن اجتهادات المحاكم المتمثلة في أحكام وقرارات تصدرها السلطة القضائية لا تخلو من الأهمية، فكثير هي تلك الاجتهادات التي كانت هي المحرك الأساسي إن لم يكن الوحيد في توجيه المشترع للتدخل في بعض المجالات والتي كان المشترع في غفلة عنها، إلا أن الوقائع والظروف التي عرضت أمام المحاكم ووضعت القضاة في حيرة من أمرهم، وخشية من تضارب الأحكام وجد المشترع نفسه مضطراً للتدخل ليقطع دابر كل خلاف. من هذه الأفكار والمنطلقات إن وجود القرارات القضائية في مكتبة رجال القانون وطلبته أمر بغاية الأهمية لمعرفة كيف يسير العمل بهذه النصوص القانونية الموجودة بين أيدينا وكيف كانت تطبق وكيف صارت تطبق في مضمار الحقبة الزمنية التي يحياها النص، وهكذا تكون هذه القرارات هي بمثابة أضواء ودلائل تنير لكل باحث درب البحث السليم.
