طه جابر العلواني (1935 - 4 مارس 2016)، هو مفكر وفقيه إسلامي عراقي. كان رئيس المجلس الفقهي بأمريكا، ورئيس جامعة العلوم الإسلامية والاجتماعية (SISS) بهرندن، فرجنيا، الولايات المتحدة الأمريكية. حصل على الدكتوراة في أصول الفقه من كلية الشريعة والقانون بجامعة الأزهر في القاهرة، مصر، عام 1973. كان أستاذاً في أصول الفقه بجامعة الإمام محمد بن سعود الإسلامية بالرياض، المملكة العربية السعودية منذ عام 1975 حتى 1985. في عام 1981 شارك في تأسيس المعهد العالمي للفكر الإسلامي في الولايات المتحدة، كما كان عضو المجلس التأسيسي لرابطة العالم الإسلامي في مكة المكرمة، وعضو مجمع الفقه الإسلامي الدولي في جدة. هاجر إلى الولايات المتحدة في عام 1983. وكان رئيس جامعة قرطبة الإسلامية في الولايات المتحدة.

هل كان رسول الله في قيادته جيوش المسلمين - في خمس وثلاثين غزوة غزاها بنفسه - قائداً عسكرياً عاماً لدولة بالمفهوم المعاصر للدولة، أو أنه كان يتلو على الناس آيات الله ويعلمهم الكتاب والحكمة يزكيهم - ومن التزكية تقديم الأسوة والقدوة لجميع الفصائل - بأفضل الطرق وأيسرها؟.
هل كانت وثيقة المدينة المنوّرة دستوراً أو بديلاً عن الدستور في المفهوم المعاصر، أو كانت عقداً إجتماعياً بين فصائل يعترف كلٌّ منها بالآخر إعترافاً تاماً، وبحقه في توقيع ذلك التعاقد مع الفصيلين الآخرين أو الإنسحاب منه، أو أنه كان دستور دولة موحّدة؟...
تحاول هذه الدراسة - بإيجاز - الإجابة عن هذه الأسئلة وما يتصل بها، سائلين العلي القدير أن يُلهمنا القول السديد والرأي الرشيد في ذلك كله.
