أما القسم الثاني في أحكام الوصية والوقف، حيث تحدث الباب الأول عن: تعريف الوصية وحكمها وحكمة مشروعيتها والفرق بينها وبين الميراث وأركان الوصية وشروط كل ركن، وأنواع الوصية ومبطلاتها والوصية الواجبة وتزاحم الوصايا، ومبطلات الوصية. وتناول الباب الثاني الحديث عن تعريف الوقف وأنواعه وأركانه وشروطه كل ركن وانتهاء الوقف.
