رافق عصر العولمة مؤشرات عديدة لبروز ظاهرة جديدة عُدت من أهم مخاطر العولمة المالية بشكل خاص، تمثّلت بما اصطلح على تسميتها في التشريعات القانونية الدولية والمحلية بعمليات غسيل أو تبييض الأموال (Money Laundering) ، ويُنظر إلى هذه الظاهرة كواحدة من الآفات التي أصابت الإقتصاد في دول العالم المختلفة سواء المتقدمة منها أو النامية.
وقد وُضعت عمليات تبييض الأموال ضمن فئة الجرائم الإقتصادية المرتكبة من قبل عصابات الجريمة المنظمة (المافيا) حيث يلجأ المجرمون إلى أساليب ملتوية ومعقدة لنقل وتحويل الأموال المتحصّلة من الأعمال المخالفة للقانون بغية إخفاء وتمويه مصدرها الحقيقي وإضفاء الصفة الشرعية عليها.
إزاء هذا الواقع وجب النظر في الدوافع التي تؤدي إلى عمليات تهريب الأموال وتبييضها وهل تتناسب مع المفاهيم الإنسانية الصحيحة والطرق التشريعية لمجابهتها عامة، ودور قانون العقوبات في مكافحتها خاصة؟
في ضوء ما تقدم، اختار المؤلف الموضوع "دور قانون العقوبات في مكافحة جرائم تبييض الأموال" كنوع من أنواع المواجهة التشريعية لمكافحة هذه الظاهرة، ليكون محلاً لهذه الدراسة تماشياً مع اهتمامات الفكر القانوني المعاصر الذي أصبح يولي عناية ملحوظة لمختلف الموضوعات المتعلقة بعائدات الجريمة بوجه عام ولموضوع تبييض الأموال غير المشروعة بوجه خاص بالنظر للأضرار والمخاطر الناجمة عنها والمشكلات العديدة المتصلة بها، لا سيما فيما يتعلق بفعالية مكافحة الجريمة وفرض حكم القانون وتعزيز نظم العدالة الجنائية.
أما الموضوعات التي تشكل صلب هذه الأطروحة وجوهرها، فتم تناولها في باب رئيسي أول يرمي إلى استجلاء دور قانون العقوبات في مكافحة جرائم تبييض الأموال، من منظور الوثائق الدولية الأساسية والشرائع العقابية المقارنة، لا سيما فيما يتعلق بالبنيان القانوني للجريمة موضوع البحث والجزاءات الجنائية المقررة لها مع محاولة تبيان موقف كل من قانوني العقوبات اللبناني والمصري إزاء هذه الظاهرة. وفي الباب الثاني أورد المؤلف القواعد الإجرائية في مكافحة هذه الجريمة في كلا القانونين المذكورين مقارنة لما جاء عليه في الإتفاقيات الدولية، وعرض في الفصل التالي لإجراءات مكافحة تبييض الأموال.
