ان التقدير الشرعي يمثل قاعدة ومعنى عاماً في الشرع لا يخلو منه باب فقهي. ولما كان التقدير الشرعي عبارة عن إعطاء الشيء منزلة على خلاف واقعه، كان هذا مستدعياً لأن يكون التقدير منبعثاً عن سبب معتد به شرعاً، ثم إن صورة التقدير هذه قد جعلته واقعاً على خلاف الأصل؛ إذ الأصل أن يعطي الشيء حكمه على وفق واقعه، ولما كان هذا شأن التقدير الشرعي كان لابد من الاقتصار على ما تدعو الحاجة إليه منه.
