إن علم الفقه وأحكامه الدينية يعتبر من أجل العلوم الشرعية، لا تقوم الأمة الإسلامية حق القيام إلا به، ولا تتأسس حضارتها وعمرانها إلا عليه وفي ظله، ولا يصح لأي فرد منها أن يقدم على تصرف حتى يعلم حكم الله فيه منه، لأته وحده القانون المنظم لحياة المسلم وتصرفاته، والمتكفل الأجدر بإيجاد التشريع المناسب، لكل ما يستجد من تطورات وأحداث في حياته. ولأهميته البالغة هاته رغب الشارع بتعلمه وتعليمه وحض المشتغلين والمهتمين به بميزات لم ينلها غيرهم من المهتمين بالعلوم الأخرى. وقد قيض الله لهذا العلم في المذهب المالكي علماء أفنوا أعمارهم في خدمته. فكان منهم رواد أسسوه حتى أصبح علماً مستقلا له مباحث يختص بها. وكان منهم بناة أعلوا صروحه بالتهذيب والترتيب والاختصار والتنقيح لأمهات ودواوين المذهب، وهم كثيرون منهم الإمام أبو عبد الله محمد بن نجم جلال الدين المعروف بابن شاس الجذامي المصري (ت 616 هـ) الذي وإن قل فاته الانتماء إلى جيل الرواد المؤسسين لتأخره الزمني، فإنه لم يفته أن يكون من زمرة المحققين المنقحين، والمؤلفين المحررين حتى أصبح مقصد طلاب العلم ومحط آمالهم، ونظرا لمكانة جلال الدين ابن شاس، وطول باعه في الفقه، عمد المحقق إلى الاعتناء بكتابة عقد الجواهر الثمينة في مذهب عالم المدينة كما وعمد إلى دراسته، وكان وراء اختياره هذا أسباب أخرى متعددة منها: أولا: لأنه كتاب جامع لأبواب الفقه و مختصر لآراء فقهاء المذهب، ثانيا: لأنه من أمهات الكتب المالكية التي اتخذها الفقهاء من بعده مصدراً ومرجعاً لكتبهم وآرائهم، حيث نقلوا عنها واستفادوا منها جيلا بعد جيل. ثالثاً: لاحتوائه على نصوص ثمينة لفقهاء أعلام قد ضاعت أصول كتبهم فيما ضاع من نفائس الفقه الأصيل، ككتاب المجموعة لابن عبدوس وكتاب الموازية لمحمد بن المواز وغيرهما. رابعاً: لحسن تبويبه وتفصيله وتفريعه الذي امتاز به عن غيره من كتب وقته. خامسا: لأهمية مؤلفه الإمام ابن شاس الذي بلغ من المكانة العلمية أن غالى العلماء في الثناء عليه، والتنويه بقدره، قال فيه ابن خلكان:" كان فقيها فاضلا في مذهبه عارفاً بقواعده.
