"حيث المجتمع ثمة شرع"، قبائل عرفت شرع حمورابي ، والإغريق أقاموا الألواح الأثني عشر، والرومان اتبعوا قوانين يوستنيانوس، وليس من أمة عبر التاريخ لم تسنّن قانوناً أو تنتهج عرفاً. لكن المجتمع الإسلامي امتاز من سائر الأمم بأنه أول من وضع منطقاً للشرع تحت إسم "أصول الفقه". فعلم الأصول هذا، لكونه نشأ إسلامية، واعتبر بالتالي في خدمة عقيدة مغايرة لعقيدة الغرب، لم ينقل في القرون الوسطى أو بعدها مع سائر العلوم التي ترجمت إلى اللغات الأجنبية، لذلك فالحضارة الغربية التي لحقت بالحضارة العربية تأخرت حتى القرن العشرين في وضع أسسالمنطقية للحقوق والأخلاق. هذا دان أصول الفقه، وإن كان من حيث نشأته متعلقاً بالفقه الإسلامي وبالتالي بأحداث تاريخية عينية، فهو من حيث كنهه علم كلي مجرد لا يمت بصلة إلى دين أو مجتمع بصلة ذاتية، بل إنه يصلح لأن يكون قالباً لكل شرع وخلق وبقول آخر، إن علم الأصول، خلاقاً لما ذهب إليه نظار العرب ومن بينهم ابن خلدون، هو من العلوم العقلية وليس من العلوم النقلية، بل هو بين العلوم الشريعة في أعلى درجات التجريد، من شموليته وشرف مرتبته اللذان نوّه بهما القدماء. حول هذه النقطة يدور البحث في هذا الكتاب، ولن يكون البحث مجرد عرض تقليدي لموضوعات الأصول ولا دراسة تاريخية لنشأته وتطوره، ولا أيضاً مقارنة بين المذاهب المختلفة، لأن غرض الباحث في عمله هذا استخراج التبر من التراب، حيث يقيم انطلاقاً من الأصول منطقاً حديثاً للحقوق والأخلاق. وبعبارة أخرى استجلاء الرسالة الرمزية في أصول الفقه.
