إنّ زراعة الأعضاء البشرية من المسائل التي ظهرت بسبب التقدم العلمي الكبير خاصة في المجال الطبي، إذ تعتبر وسيلة من وسائل علاج المرضى وشفائهم، وقد انتشرت بصورة واسعة في مختلف دول العالم، كما ظهرت في الآونة الأخيرة الكثير من الدراسات والبحوث التي تهدف إلى إبراز موقف الشريعة الإسلامية في هذا الموضوع، إضافة إلى صدور قرارات من مختلف الهيئات والمجالس والمجامع الفقهية محاولة هي الأخرى إبراز الحكم الشرعي لهذه المسألة التي كثر حولها الكلام وتعددت فيها الآراء بين مؤيد ومعارض، وهذا وقد نجم عن ذلك مسألة خطيرة تتمثل في ظهور الإتجار بالأعضاء البشرية، وجعلها محل معاوضات مالية، مما جعل هذه المسألة محط أنظار الفقهاء والدارسين، والتي سنحاول بإذنه سبحانه وتعالى معالجة ذلك من خلال الإجابة على التساؤلات الآتية: ما الحكم الشرعي لعملية الزرع، ونقل الدم؟...
وهل يجوز بيع هذه الأعضاء البشرية، وكذا دم الإنسان، ولبن الآدمية، بإعتبارهما عضوين سائلين، أم أن ذلك يتعارض مع تكريم المولى عزّ وجلّ للإنسان، ويعتبر ذلك إمتهاناً له ومساساً بكرامته الإنسانية التي خصه الله تعالى بها دون سائر المخلوقات، مما يجعل هذا البيع فاسداً؟... وما هي قرارات الهيئات الشرعية، والمجاميع الفقهية الصادرة في هذا الموضوع؟... وما هي النظرة القانونية لهذه المسألة؟...
هذا ما سوف نجيب عنه ونتناوله بالدراسة من خلال هذا الكتاب الذي نرجو أن يكون عضداً للفقيه، وعوناً للطبيب، وتبصرة لرجل القانون، سائله المولى عزّ وجلّ ان يتقبل مني الجهد المبذول فيه وأن ينفع به، وما ذلك عليه بعزيز.
