يعني بما شهدته السنوات الأخيرة من تطور في ميدان الطب على نحو صار معه القواعد القانونية التي تحكم العمل الطبي التقليدي محل جدال، وكانت الأعمال الطبية التقليدية تتميز بالبساطة التي استتبعت وضوح حكمها في القانون إذ كانت تضع الطبيب في علاقة مباشرة مع مريضه، وكانت هذه العلاقة بناء على ذلك ثنائية وكانت هذه الأعمال تعتمد في نجاحها على مهارة الطبيب وخبرته.
وعلى النقيض من ذلك فإن الأعمال الطبية الحديثة تتميز بخصائص مختلفة والعلاقة التي تنشأ بها ليست محض علاقة ثنائية تربط بين الطبيب والمريض، وإنما يتدخل فيها شخص ثالث يشارك مشاركة إيجابية في سير العمل الطبي، ومن هنا يثور التساؤل حول تحديد التكييف القانوني لعمل الطبيب إزاء هذا الشخص.
بالإضافة إلى ذلك فإن نجاح العمل الطبي الحديث لا يعتمد على مهارة الطبيب أو عمله أو خبرته وإنما يعتمد كذلك على الآلة التي يستعان بها. وقد عني هذا الكتاب بدراسة أهم الأعمال الطبية الحديثة وهي نقل الأعضاء سواء بين الأحياء أو من ميت إلى حي، مشروعيتها وشروطها وصورها في محاولة متواضعة للوصول إلى حلول تتماشى وأحكام القانون والدين والأخلاق.
وهو إسهام متواضع مع الدعوة إلى الله أن ترقى العناية بالإنسان العربي إلى أعلى المستويات، بحيث يصبح صوت رجال القانون والطب وعلماء الدين واحداُ تحت شعار دعا إليه أبقراط عند دخوله على مريض (أنا والعلة وأنت ثلاثة) فإن أعنتني عليها بالقبول مني لنا تسمع صرنا اثنين وانفردت العلة فقوينا عليها، والاثنان إذا اجتمعا على واحد غلباه.
