إنّ حماية الصحفيين ووسائل الإعلام يمكن أن تكون محلاً للدراسة من ناحيتين مختلفتين، حيث إن هذه الحماية في حالة السلم تختلف عنها في حالة النزاع المسلح، ففي الحالة الأولى، هناك آليات قانونية تُمكن الصحفي من الدفاع عن حقوقه استناداً إلى أحكام القانون الدولي لحقوق الإنسان، من خلال الإعلان العالمي لحقوق الإنسان والعهد الدولي للحقوق المدنية والسياسية وغيرها.
ويكون الأمر مختلفاً إذا تطرقنا إلى موضوع حماية الصحفيين ووسائل الإعلام أثناء النزاعات المسلحة، حيث تخضع الحماية في هذه الحالة إلى أحكام القانون الدولي الإنساني من خلال اتفاقيات لاهاي لعام 1899 ــ 1907 واتفاقيات جنيف لعام 1949 والبروتوكولين الإضافيين لعام 1977.
وسنقتصر في هذا البحث على الحماية التي يوفرها القانون الدولي الإنساني للصحفيين ووسائل الإعلام أثناء النزاعات المسلحة. إن دور الصحفيين والإعلام بصفة عامة في أوقات النزاع المسلح جدير بالاهتمام، بل إن كل انتهاكات القانون الدولي الإنساني، قد كشف عنها الإعلام بطريقة أو بأخرى، لذلك فإن الإعلام يقيد ــ إلى حد ما ــ حرية الأطراف المتحاربة في استعمال كل أساليب الحرب المحرمة بمقتضى القانون الدولي الإنساني.
