قانون العقوبات هو مجموعة القواعد التي تسنها الدولة لتبين ما يعد جريمة وما يفرض لها من عقوبة. والتعبير عن هذه القواعد بقانون العقوبات يبرره أن هذا القانون يتميز عن فروع القانون الأخرى بما يقرره من عقوبات بالمعنى الفني للعقوبة كأداة إصلاح وليس كأداة انتقام. ومع ذلك لا زال بعض الشراح يستعمل اصطلاح القانون الجنائي بدلاً من اصطلاح قانون العقوبات، نسبة إلى الجناية وهي أخطر الجرائم.
والتعبير بالقانون الجنائي نشأ لدى الرومان حين كانت الجنايات وحدها من جرائم القانون العام، أما الجنح فكانت من جرائم القانون الخاص. وبالرغم من نشأة التقسيم الثلاثي للجرائم إلى جنايات وجنح ومخالفات والإجماع على أنها كلها تمس الصالح العام فقد بقي التعبير بالقانون الجنائي أثراً من آثار القانون الروماني. وهو تعريف لا يفي بالغرض إذ يدل على نوع واحد من الجرائم وهو الجنايات. فما لا شك فيه غذن أن اصطلاح قانون العقوبات أشمل وأدل من اصطلاح القانون الجنائي. ويمكن القول بأن قانون العقوبات بمعناه الصحيح هو الذي يحتوي على القواعد الموضوعية ويتكون من قسمين أما القسم الأول وهو القسم العام الذي يختص بالأحكام المسؤولية الجنائية وأنواع العقوبات وأسباب تشديدها وظروف تخفيفها وهذا القسم هو موضوع هذه الدراسة التي بين يدينا والتي توزعت على قسمين الأول تحدث عن الجريمة والثاني تحدث عن الجاني. أما القسم الثاني فهو القسم الخاص ويشتمل على تعريف كل جريمة على حدى.
