تتناول هذه الدراسة أحكام حماية المرأة من الإيذاء في ضوء النظام ولائحته التنفيذية بالمقارنة مع الفقه الإسلامي، وترصد أبرز مواقف الاتفاقيات الدولية المهتمة بالمرأة، حيث صادقت المملكة العربية السعودية على الانضمام لبعضها، كما أن النظام أثار جدلًا واسعًا في مفهوم الإيذاء، ونطاق تطبيقه، وما يندرج تحته من صور مجرمة تقوم مع كل صورة منها جريمة إيذاء، وبالتالي تتشكل معه الأحكام الموضوعية لجريمة الإيذاء، ويستحق مرتكبها العقوبة المقررة حال إدانته، وبين ما لا يعد جريمة ويخرج عن هذا المفهوم، وفي الإطار ذاته ترصد الدراسة التشابه بين صور التجريم في نظام الإيذاء وغيره من الأنظمة السعودية، وتكشف عن مدى كفاية نصوص التجريم والعقاب، كما يبنى على ما تقدم ضرورة بيان الأحكام الإجرائية لجرائم الإيذاء فيما يعد داخلًا في نطاقها، وآلية رفع الدعوى المدنية الناشئة عن جرائم الإيذاء لنظرها من المحكمة الجزائية المختصة، وانتهاءً بالكشف عن إجراءات المحاكمة، والضمانات التي تتمتع بها المرأة المتعرضة للإيذاء في هذه المرحلة، ومن هنا تأتي هذه الدراسة لتقدم ما يلزم من بيان مع الحلول الملائمة مما له صلة بالمشكلة.
