يرمي هذا البحث إلى المساهمة في بناء نظرية عامة لحق التقاضي في الدعوى الجزائية، وهذا يعني إقامة العدل بالقسط بين الناس وتأمين حقوقهم وحرياتهم، وهذه مهمة السلطة القضائية وهي إحدى وظائفها الرئيسية إلى جانب السلطتين التشريعية والتنفيذية التي يقوم عليها نظام الحكم. فبرأي مؤلف الكتاب أن هذه المهمة هي ما يبرر وجودها وبقاءها، وكان مؤدى هذا التسليم بأن إقامة القضاء فرض عين في حق الدولة، ومن ثم فهي ملزمة بأن تكرس المبادىء القانونية التي يشيد عليها صرح القضاء العادل وأن ترفع عن طريقه ما قد يعترض سبيله نحو بلوغ غايته وأداء مهمته. ومن هنا تكمن أهمية هذه الدراسة لموضوع (حق التقاضي في الدعوى الجزائية) إذ أن سائر الحقوق والحريات مرهونة بكفالة هذا الحق، فعن طريقه يتمكن كل شخص من الدفاع عن حقوقه ورد الإعتداء عليها.
وفي الكتاب يلجأ المؤلف إلى بيان موقف الشريعة الإسلامية بشكل مستقل من هذا الموضوع، ويعقد مقارنة من خلال إستعراض أحكام معظم الإتجاهات المختلفة في التشريعات الوضعية وحكم القانون الجنائي العراقي في كل جزئية من البحث، إذ تم جمع المعلومات المستخلصة من عموم هذه الدراسة وتنظيمها بإطار علمي وفق إتساق منطقي، وقد اتخذ المؤلف من التطبيقات أساسا لتعزيز المعلومات في سبيل إبراز التوافق بين النص وسبل تطبيقه.
