Book Description
هذا هو الكتاب الثاني الذي يصدره المؤتمر الإسلامي للشريعة والقانون في لبنان. وقد تناول هذا المؤتمر موضوع "التحكيم المطلق"، ذلك أن أهمية التحكيم باتت لا تخفي على أحد من رجال الفقه والقانون أو رجال المال والأعمال. وعملاً بقوله تعالى: "فلا وربك لا يؤمنون حتى يحكّموك فيما شجر بينهم ثم لا يجدوا في أنفسهم حرجاً مما قضيت ويسلموا تسليما".
وبناءً على أحكام قانون أصول المحاكمات المدنية اللبناني الصادر بموجب المرسوم الاشتراعي رقم 90 تاريخ 1983/9/16 والتعديلات الواردة عليه لا سيما المادة 777 منه التي تنص على ما يلي: "في التحكيم المطلق يعفي المحكم أو المحكمون من تطبيق قواعد القانون وأصول المحاكمة العادية ويحكمون بمقتضى الإنصاف".
وحيث أن التشريع اللبناني والتشريعات العربية والأجنبية اعترفت بالتحكيم المطلق الذي يجيز للطريفين المتحاكمين توليه محكم يفصل بينهما بمقتضى العدالة والإنصاف، بما يتيح المجال لتحكيم الشريعة الإسلامية الغراء وتلافي الوقوع في المخالفات الشرعية التي نصت عليها القوانين الوضعية مما يستوجب العمل على إنشاء مركز إسلامي للتحكيم.
لذلك كانت الدعوة لهذا المؤتمر بموضوع: "التحكيم المطلق في ضوء الشريعة والقانون" والذي افتتح أعماله يوم الأحد تاريخ 17 صفر 1421هـ الموافق 21 أيار 2000م، في مجمع الإصلاح الإسلامي بطرابلس-لبنان.
وقد خلص المؤتمر إلى سد ثغرة هامة في المكتبة الفقهية والقانونية في لبنان والعالمين العربي والإسلامي. كما أن توصيات المؤتمر اتجهت نحو الجانب العملي التطبيقي دون الإغراق في النظريات، وذلك إيماناً منه بأن تغيير واقع التعامل والتقاضي بين الناس إنما يكون بطرح بدائل قويمة وعملية.
