تعتبر الأسرار التجارية فرع من فروع الملكية الفكرية في القانون الأردني والقانون الأمريكي واتفاقية تربس، حيث أشارت الفقرة (ب) من المادة التاسعة من قانون المنافسة غير المشروعة والأسرار التجارية الأردني رقم 15 لسنة 2000 إلى أن الأسرار التجارية تعتبر من حقوق الملكية الفكرية، بقولها:
"تشمل حقوق الملكية الفكرية المذكورة في الفقرة أ من هذه المادة، بوجه خاص ما يلي:
-حقوق المؤلف والحقوق المجاورة لها.
-العلامات التجارية.
-المؤشرات التجارية.
-الرسوم الصناعية والنماذج الصناعية.
-براءات الاختراع.
-التصاميم للدوائر المتكاملة.
-الأسرار التجارية.
-الأصناف النباتية الجديدة".
ويكون المشرع الأردني في موقفه هذا قد تماشى في توجهه مع اتفاقية الجوانب المتصلة بالتجارة من حقوق الملكية الفكرية (تربس) ومع القانون الأمريكي الخاص بحماية أسرار التجارة. فحسب النظام القانوني الساري في الأردن وفي الدول التي انضمت إلى اتفاقية تربس، تشكل حماية الأسرار التجارية جزءً من المفهوم العام، للحماية من المنافسة غير المشروعة، وتقوم على أحكام خاصة بشأن حماية المعلومات السرّية.
وقد عالجت اتفاقية (تربس) موضوع (حماية المعلومات غير المفصح عنها)، على اعتبار أنها من فروع الملكية الفكرية، حيث وضعت في المادة التاسعة والثلاثين منها نظاماً لحماية الأسرار التجارية والصناعية - موضوع هذا الكتاب- من خلال آليات خاصة بها تتضمّن الإحالة إلى المادة العاشرة مكرر من اتفاقية باريس وقد جاء نص المادة التاسعة والثلاثين من اتفاقية تربس بالقول: "أثناء ضمان المنع الفعال للمنافسة غير المنصفة حسب ما تنص عليه المادة 10 مكررة من اتفاقية باريس (1967).
