لا يتوقف قمع مرتكبي جرائم الحرب، وباقي الجرائم الدولية؛ على سنّ أركان لها فقط، أو وضع أجهزة قضائية لمحاكمة مرتكبيها، بل يجب تعاضدها مع إجراءات تكفل متابعة أولئك المجرمين، وتوقيع العقوبة عليهم، وحتى تنفيذها.
ويرمي هذا المؤلف إلى بيان الجانب الإجرائي المتعلق بمتابعة مرتكبي جرائم الحرب سواء بإتباع المبادئ الإجرائية الجزائية الداخلية قديمها وجديدها، بداية من مبدأ إقليمية النص الجزائي الإجرائي، وصولاً إلى أحدث مبدأ إجرائي متعلق أساساً بمتابعة مرتكبي الجرائم الدولية داخليّاً، وهو مبدأ الإختصاص الجنائي العالمي، او دولياً باللجوء إلى مختلف أنواع المحاكم الجنائية الدولية المؤقتة؛ كالمحاكم الجنائية المدوّلة مثل المحكمة الجنائية الدولية الخاصة بدولة السيراليون، أو المحاكم الجنائية الدولية الخاصة، مثل المحكمة الجنائية الدولية الخاصة بيوغسلافيا سابقاً، أو محكمة رواندا؛ التين تسيران للإضمحلال بعد إنشاء آخر وأحدث جهة قضائية دولية لمتابعة مجرمي الحرب؛ وهي المحكمة الجنائية الدولية الدائمة والتي انبثقت عن معاهدة دولية تضمّنت نظام إجرائي وموضوعي متكامل نوعاً ما.
وتبقى العوائق الإجرائية، والتي تناولها هذا المؤلف، مثبطاً للوصول إلى تطبيق العدالة الجنائية الدولية على مرتكبي جرائم الحرب، يجب تلافيه لتحقيق المبتغى.
