Book Description
إذ نبتدئ الدخول في غمار بحث قانوني حول (عقوبة الإعدام في التشريع العراقي-دراسة مقارنة)، لابد أن نتذكر أنّ هذه العقوبة من أقدم صور العقاب وجوداً، وأشدها جسامة، وهي أكثر العقوبات التي أثارت جدلاً فقهياً في شانها، لدراسة، مدى صلاحيتها من حيث الإبقاء والإلغاء.
ومما يلحظ على البحوث القانونية، اهتمامها المتزايد بدراسة هذه العقوبة لما تتمتع به من أهمية خاصة تتمثل بخطورة أثارها، إلا أنّ ما كتب حولها من البحوث جاء يعالج بعضاً من جوانبها من جهة، فضلاً عن دخول غالبية مضامينها ضمن دراسات: السياسة الجنائية، أو علمي الإجرام والعقاب من جهة ثانية.
ولمّا كان إلغاء هذه العقوبة يتعارض والأحوال الاجتماعية، والسياسية، والشرعية للعراق، وإزاء ندرة الدراسات القانونية المعمّقة الخاصّة ببحث عقوبة الإعدام كموضوع من موضوعات التشريع بوجه عام، وقانوني العقوبات وأصول المحاكمات الجزائية بوجه خاص، فقد غدا البحث فيها -على هذا النحو- حاجة علمية ماسّة، الأمر الذي كان من جملة ما شدني إلى اختيارها موضوعاً لهذه الدراسة.
وتكمن أهمية البحث في عقوبة الإعدام من هذه الزاوية، في انّه يسعى لدراسة الأحكام الموضوعية والإجرائية لهذه العقوبة والتعرّف على مدى ملاءمتها وفيما إذا كانت بحاجة إلى تعديل.
ولغرض دراسة عقوبة الإعدام من هذه الجهة، بصورة مفصّلة فانّ الأمر يقتضي تأصيلها من الناحية التاريخية، في تمهيد نتناول فيه التطوّر التاريخي لها، في تشريعات وادي الرافدين، ومصر الفرعونية، والقانون الرّوماني، ثم بيان ذلك التطوّر في بعض تشريعات العصر الحديث، كفرنسا وإنجلترا، والتشريع الجزائي للعراق الحديث.
