ركزت هذه الدراسة المتواضعة على المعارضة السياسية بوسائلها السلمية والمدنية من خلال النصوص الدستورية والقوانين المتعلقة بتنظيم الحياة السياسية في النظام السياسي بوجه العام والعراق بوجه خاص.
فوجود معارضة دستورية متوازنة في أية دولة تكون ضمانة مهمة لإستقرارها السياسي والإجتماعي تخدم الوحدة السياسية للدولة، فإن البحث في الأطر الدستورية والقانونية للمعارضة السياسية ودورها وفعاليتها ووجود ضمانات قانونية تكفل لها القيام بتلك المهام.
بما أن العراق عاشت منذ تأسيسها عام 1921 تحت دوامة العنف والإقتتال والحروب الأهلية والدولية من خلال أنظمتها السياسية المتعاقبة والموصفة بالشمولية والإستبداد، فلم يتيح الفرصة أمام شعبه بواسطة التيارات السياسية والحزبية، معارضة سياسية حقيقية.
وهذا الواقع هيمن على الحياة السياسية والقانونية في دولة العراق عام 2003 خصوصاً بعد الإحتلال، فبعد عام 2003 فتح مخرج جديد لا مثيل له في تأريخ العراق المعاصر، الذي أدى إلى تغير جذري في بنيته السياسية والدستورية للنظام السياسي العراقي.
فبعد أن التأريخ بدأت مرحلة جديدة للحياة السياسية في العراق مرحلة تتسم بالتعددية السياسية والبرلمانية، ومن ثم بعد ذلك وضع دستور جديد للعراق، وعلى ضوء هذا الدستور الجديد، نحاول ان نسلط الضوء على تلك النصوص والقوانين التي يمكن أن تستفيد منها المعارضة السياسية للعمل وكذلك لكي تقوم بدورها الفعال في العملية السياسية.
من هنا، يثور السؤال: هل أن الدستور الجديد نص على حق المعارضة أم لا؟ إذا لم ينص على تلك الحقوق، إذن على ماذا تستند القوى السياسية في ممارسة حق المعارضة السياسية؟...
