إن من آيات الله: أن خلق الانسان مختلفاً في ألسنته وألوانه : { ومن آياته خلق السماوات والأرض واختلاف ألسنتكم وألوانكم إن في ذلك لآيات للعالمين} ولم يقف الاختلاف عند هذا الحد بل جاوزه إلى المواهب الخلقية، والاستعدادات الفطرية، والمدارك الذهنية، وبالتالي شمل الآثار من الآراء العقلية، والتصرفات القولية والفعلية.
وبذلك أصبح الاختلاف جزءً من طبيعة الانسان، يبدأ من تكوينه ويرافق أدوار حياته فيمر بمداركه وينتهي بآثاره، فهو سبحانه وتعالى لم يشأ جعل الناس أمة واحدة لأن الاختلاف هو الذي ينسجم مع طبيعته، فيتفق وما يحمله من التفاوت في المدارك والنزعات والمؤهلات الذاتية والعرضية، بالإضافة إلى المؤثرات الأسرية والبيئية.
والاختلاف منه ما هو مذموم كاختلاف أهل البدع والأهواء، ومنه ما هو ممدوح كاختلاف فقهاء الصحابة والتابعين والأئمة المجتهدين لكونه مبنياً على استنباط الأحكام من نصوص الكتاب والسنة ومستنداً إلى أسباب أقرها الشرع.
ويذكر أن ما دفع المؤلف الجليل إلى اختيار موضوع "أسباب اختلاف الفقهاء في الأحكام الشرعية" عدة أمور هي : العمل على تطوير الدراسات الأصولية والفقهية والإفادة من نتائج التلاقي الفكري في اوسع نطاق عن طريق ربط الفقه بأصوله، كما هدف إلى تقريب شقة الخلاف بين المذاهب والاسلامية ومحاولة البلوغ إلى واقع الفقه الاسلامي من أيسر طرقه وأقصرها، وإزالة الشكوك التي تساور بعض النفوس الضعيفة ، وتقويم الجهود المشكورة التي قدمها هؤلاء الأئمة الأعلام للأمة الاسلامية.
