فقدان الأساس القانوني يعني أن القرار يفتقر إلى أسباب واقعية كافية يمكن معها القول بتطبيق القاعدة القانونية عليها أو أن الأسباب الواقعية هي ناقصة أو غامضة بحيث يتعذر على محكمة التمييز إجراء رقابتها على الحل القانوني المعطى لتلك النتائج.
وفي هذا الكتاب يقدم المؤلف عرضاً شاملاً للسبب التمييزي السادس المنصوص عنه في المادة 708 من قانون أصول المحاكمات المدنية الأساس القانوني للقراء المطعون فيه. على أن المادة التي يتغذى منها هذا القرار هي قرارات ممكنة التمييز وقد تطرق المؤلف إلى تحديد مفهوم فقدان الأساس القانوني. وللمنحى الاجتهادي الذي كان يعتبر بأنه لا يجوز الإدلاء بالتشويه تحت سبب فقدان الأساس القانوني.
كما يعرض هذا الكتاب أيضاً للمنحى الاجتهادي الذي كان يعتبر بأن التشويه يؤدي إلى فقدان الأساس القانون ويقدم بعض التطبيقات المحلية التي تعني مدى تحقق فقدان الأساس القانوني.
والكتاب يضم بين دفتيه عدداً كبيراً من اجتهادات محكمة التمييز المدنية المتعلقة بفقدان الأساس القانوني للقراءات الاستئنافية.
