اجتهد الفقه القانوني والسياسي في فصل الجهاز الإداري للدولة عن الجهاز السياسي وأصبح الولاء للدولة لا الحكومة وتم تفعيل الأجهزة الرقابية تلك التي تنشغل بفحص القرارات والأعمال الإدارية بهدف تقدير مشروعيتها كما ظهرت الحاجة الماسة إلى وضع ضمانات ينبغي مراعاتها عند إلحاق الأفراد بالجهاز الإداري للدولة ومن ناحية أخرى ضمانات لهم عند تأدية وظيفتهم والتزامات عليهم أن هم انحرفوا عن جادة الصواب.
كل هذه الغايات التنظيمية وإن كانت تمثل غاية منشودة لكافة الأنظمة القانونية إلا أن الدول لم تصل إليها بصورة متساوية ورغبة منا في بحث هذه الضمانات وتلك الحقوق ومدى تحققها في بلدنا العزيز سيحاول الباحث تلمس مسائل التعيين في الوظائف العامة ومن ثم مزاولة هذه الوظائف في دراسة مقارنة لتقدير مدى اتساقها مع التنظيمات الإدارية الحديثة لن نتوقف في ذلك عند النصوص التشريعية وإنما فاعلية هذه النصوص في التطبيق ولبلوغ هذه الغاية نقسم هذا البحث إلى بابين يتعلق الأول بالوظيفة العامة ومبدأ الجدارة ثم نعقبه بباب أخير نعرض فيه للأثر المترتب على انعقاد الرابطة الوظيفية والمتمثل في نفاذها وما تفرضه من حقوق للموظف والتزامات عليه ثم مآل الرابطة الوظيفية عند انقضائها والأسباب المختلفة التي تحقق هذا الانقضاء.
