تعد السياحة ظاهرة إجتماعية وإنسانية، تطورت وازدهرت على نحو أصبحت اليوم تمثل خاصية العصر الحديث، وتتجلى أدوات ممارسة النشاط السياحي بكل من وكالة السياحة والسفر والسائح طرفي العقد السياحي.
إذ يكتسب تحديد مفهوم هذا العقد أهمية خاصة ليس فقط لأنه الذي يحدد علاقة طرفيه، ومن ثم إلتزاماتهم والآثار المترتبة على مخالفة هذه الإلتزامات، بل أن هذا العقد لم يحظ بتنظيم خاص في التشريع العراقي على غرار عقود أخرى لا تقل أهمية وشيوعاً على مستوى الواقع.
الأمر الذي يعكس ضرورة تحديد مفهوم العقد من جهة، وبيان الخصائص التي يشترك بها مع غيره من العقود وتلك التي ينفرد بها من جهة أخرى.
لهذا جاء هذا الكتاب الذي يتضمن دراسة قانونية مقارنة للعقد الذي يبرمه الإفراد مع الشركات السياحية لأجل تنظيم رحلات سياحية داخل البلاد أو خارجها، إذ يُثير إبرام هذا العقد العديد من المسائل التي تستحق البحث والدراسة ولا سيما إن المشرع العراقي لم يتناول السياحة عندنا بالتنظيم بإستثناء قانون تنظيم شركات السفر ومكاتب ووكالات السفر والسياحة رقم 49 لسنة 1983.
جاء الكتاب بمعالجة قانونية لمفهوم العقد السياحي بالإضافة إلى الطبيعة القانونية والخصائص المميزة له، مع تمييزه عن العقود التي تقترب منه، ولعل آثار العقد المتمثلة بحقوق وإلتزامات كل من شركة السياحة والسياح هي من أهم المسائل التي تستحق التعرض لها للآثار القانونية المهمة التي نتتج عن إخلال أحد الأطراف بها وعلى وجه الخصوص المسؤولية القانونية للشركات السياحية التي تخل ببنود الإتفاق حول الرحلة السياحية المتفق عليها.
