دكتوراه دولة في القانون (فرنسا) 1961 بدرجة شرف الفائز الاول بجائزة الاطروحات لكلية القانون جامعة تولوز (فرنسا) 1961.
مدرس وأستاذ مساعد القانون الدستوري وفلسفة القانون – جامعة بغداد(1961-1973).
استاذ فلسفة القانون في المعهد القضائي (1977- 1988).
أستاذ القانون الدستوري وفلسفة القانون في قسم الدراسات العليا بجامعة النهرين (1992- 2002).
عضو المجمع العلمي العراقي منذ عام 1979 وزير العدل (1974-1988) وزير التعليم العالي والبحث العلمي (1988-1991) مؤسس المعهد القضائي في العراقي المؤلفات كتب اكثر من عشرين كتاباً في القانون الدستوري,فلسفة القانون .اهمها : في الدستور ,بغداد ,1964 القانون الدستوري (جزءان), بغداد 1981 الدولة الديموقراطية ,بغداد ,1998 ,بيروت 2000م نظرية السيادة ,بغداد 2002 فلسفة القانون ,عمان 2009 فلسفة الدولة ,عمان 2012
Book Description
كثيراً ما حَكمت تصرفات البشر، تصورات وأساطير أوجدها الإنسان وآمن بها.
فرضيات وأيديولوجيات اعُتمدت لحكم البشر بعيداً عن الواقع والوقائع، حيث وقفت وراءها إرادة الحكام وإيمان المحكومين، وعندها هل يمكن بناء حياة الإنسان الإجتماعية والسياسية والقانونية على مسلمات آمن الكثيرون بها ودافعوا عنها؟.
سؤال كبير يطرحه العقل ويقوده المنطق... غير أن ما يُعطى من تفسير وتبرير للسلطة وللإلتزامات التي يفرضها، يرتبط بوجود التمييز بين الحكام والمحكومين وما يثيره من تساؤل إنساني حول الدولة وسلطتها.
فالإنسان وإن سلم بسلطة الدولة يظل يريدها سلطة تمارس عبر محددات وضوابط، فابتدع القوانين والدساتير، ولم يجد فيها مبتغاه في تحقيق "إنسانيته" فنشد الحرية والمساواة في "دولة الإنسان" ليحكم نفسه بنفسه، فوقع في "التناقض الديموقراطي" حيث يكون الإنسان صاحب السلطة وموضوعها، حاكماً ومحكوماً في الوقت ذاته.
وعندما ستكون "فلسفة حكم البشر" في رؤية الإنسان لوضعه وصيرورته، وفي محاولة معرفة مشكلة الإنسان: أهي في تجاوز السلطة أم في تجاوز الإنسان.
وفي صفحات هذا الكتاب أكثر من دعوة للتفكير والتأمل في مصير الإنسان وصيرورته عبر أساطير حكم البشر.
