لقد حاول الفلاسفة والمدارس الفلسفية الحفاظ على الحد الأعلى لحرية المواطنين على الصعيد المدني والسياسي، وقد سجل دعاة الحرية نجاحات مقبولة على هذا الصعيد. ولكن دعوات الحرية تلك تغفل البعد المعنوي للإنسان الحر، ويغالي بعض هؤلاء الدعاة إلى حد الدعوة إلى تحرير الإنسان من ذاته وكرامته الممنوحة له بأصل الخلقة الإلهي، وذلك من خلال إطلاق عقال كل شهواته ورغباته...
وسوف نسعى في صفحات هذه الدراسة لعرض موقف الإسلام من قضية الحرية، لتثبت أن الإسلام لا يعارض الحرية، ولا يدعو إلى استبدالها بالأسر والتقييد، وكل ما يدعو إليه هو أن تقيد الحرية بحفظ الكرامة الإنسانية التي بها يكون الإنسان إنساناً... وإن كان ولا بد من كلمة حول المنهج فنشير إلى أننا اعتمدنا المنهج الفقهي القائم على الرجوع إلى الكتاب والسنة وغيرهما من أدوات الاستدلال في الفقه، ورغبة منها في إضفاء عمق جديد على البحث الفقهي عرضنا مقارنات بين ما يستفاد من النص الديني وبين بعض النظريات السياسية والاجتماعية حول الحرية.
وفي هذه الدراسة سنقوم باستعراض الأدلة الفقهية للحرية، لإظهار ضعف مقولة التنافي بين الدين والحرية، فكما لم تتبن الفلسفة السياسية الغربية الحرية بنحو مطلق، كذلك الفقه فإنه يرى حدوداً لهذه الحرية، لا ينبغي لها ان تتجاوزها، وهي ما سنتعرض له بالبحث.
